Reporting Copyright Infringement (DMCA Takedown Notice)

The Digital Millennium Copyright Act (DMCA) provides a process for copyright holders who believe their material appearing online infringes their rights. If you believe content published on Lucky Marjan Island infringes your copyright, you may submit a takedown notice. We will review all valid notices and take appropriate action.

Required Elements of a DMCA Notice

To be effective, your DMCA takedown notice must include the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Process

If your content was removed due to a DMCA notice, and you believe the removal was a mistake or misidentification, you may submit a counter-notification. The DMCA provides this process for content providers. We will then forward your counter-notification to the original claimant.

Required Elements of a Counter-Notice

To be effective, your counter-notification must include the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of any federal judicial district, for any judicial district in which Lucky Marjan Island may be found. You must also agree that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Repeat Infringer Policy

Lucky Marjan Island respects the copyrights of others and takes intellectual property violations seriously. We will terminate accounts of users who are found to be repeat infringers of copyrighted material. This policy applies to all content, including articles, images, and other media submitted to or posted on our site. We reserve the right to remove content at our discretion.
